Answers upon the Firm and its practice

Clear answers concerning the Firm’s practices, its method, and the manner in which a professional relationship is constituted.

What is Hoquqi?

Hoquqi is a Saudi law firm and legal consultancy established in Madinah, with offices in Jeddah and Riyadh. For fifteen years the Firm has served the institutions of the Kingdom across five specialised practices, extending from legal counsel to representation before judicial and quasi-judicial bodies. Each practice is conducted by its own specialists, with close coordination between them where a matter requires more than one construction.

What are the five practice areas?

Corporate and Transactions comprises entity formation, governance structures, mergers and acquisitions, exits, legal due diligence and contract drafting. Arbitration and Litigation comprises representation before the Saudi Center for Commercial Arbitration and the commercial courts. Restructuring and Insolvency comprises the instruments of the Saudi Bankruptcy Law in their entirety. Compliance and Investment comprises regulatory compliance, foreign investment licensing and labour relations. Wealth and Family Business comprises succession, family governance, private awqaf and family charters.

Which institutions and sectors does the Firm serve?

The Firm acts for Saudi corporations, family holdings, foreign investors entering the market, and government and quasi-government entities. Its sector experience extends across financial services and banking, retail and consumer, industry and mining, real estate and construction, health and education, technology and e-commerce, energy and major projects, tourism and hospitality, telecommunications and media, and logistics and transport. Legal knowledge taken alone leaves a matter half construed, and the Firm therefore holds the operational particulars of each sector alongside it.

How does the Firm conduct arbitration and litigation?

The Saudi arbitration system stands among the most developed in the region following the establishment of the Saudi Center for Commercial Arbitration and the reform of the Arbitration Law and the enforcement of awards. The Firm acts within that system both as arbitrator and as counsel, with extended experience in institutional disputes of substantial value, in the representation of companies and government entities in domestic and regional arbitration, and before the specialised commercial divisions of the Saudi courts.

What does the Wealth and Family Business practice comprise?

Family companies carry a difficulty of their own, since ownership meets kinship and management meets inheritance, and questions legal in appearance reach the substance of the family relationship. The practice comprises succession and generational transfer, the governance of the family company and the separation of ownership from management, private awqaf and family fund structures, family charters, and the administration of complex estates. Each family carries a composition of its own, and the work is commenced from that point.

How does the Firm approach compliance and foreign investment?

Regulatory compliance has become a strategic position for serious institutions, under a supervisory system extending to the Capital Market Authority, the Saudi Central Bank, the Oversight and Anti-Corruption Authority, the General Authority for Competition and the sector regulators. On the investment side, the Kingdom stands among the most open destinations in the region following the reform of the Investment Law and of foreign ownership, an openness that carries fine regulatory particulars requiring construction from within. The Firm undertakes compliance programmes, regulatory risk assessment, internal investigations, licensing before the Ministry of Investment, and obligations arising under the Saudi Labor Law.

How is a professional relationship constituted?

It is constituted upon an enquiry submitted through one of the Firm’s dedicated channels. A close preliminary reading of the matter follows, covering the present position of the institution, the decision or dispute before it, and the scope the matter is likely to assume. Only upon that reading is a step proposed, and the matter is assigned to the member of the team who holds the relevant specialization. The Firm accepts a matter where it holds the conviction that it may be carried to conclusion at the highest standard.
